1. INTRODUCTION AND ACCEPTANCE

1.1 About These Terms

These Terms and Conditions ("Terms") govern your use of the Perfect Scale website and services. Perfect Scale is a trading name of Abre Etteh, a sole trader architect registered with the Architects Registration Board (ARB), ("Perfect Scale", "we", "us", "our").

1.2 Agreement to Terms

By accessing our website, submitting an enquiry, or purchasing any service, you ("Client", "you", "your") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

1.3 Capacity and Authority

You confirm that:

  • You are at least 18 years of age

  • You have legal capacity to enter into binding contracts

  • If acting on behalf of a company or organisation, you have authority to bind that entity to these Terms

  • All information you provide is accurate, current, and complete

1.4 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of modified Terms. Material changes will be notified via email where practicable.

2. SERVICE DESCRIPTION

2.1 Nature of Services

Perfect Scale provides preliminary property development feasibility assessments for residential properties in England, including:

  • Residential Extension Assessments (£75-£150)

  • Additional Services: As quoted

Note: Comprehensive developer reports are not currently offered but may be available in future.

2.2 Scope of Services

Our services include:

  • Remote analysis of planning constraints and opportunities

  • Preliminary assessment of Permitted Development rights under the Town and Country Planning (General Permitted Development) (England) Order 2015

  • Indicative planning permission likelihood analysis

  • High-level cost and timeline estimates

  • Risk identification and mitigation strategies

  • Strategic recommendations for next steps

2.3 RIBA Stage Classification

All assessments are RIBA Stage 0/1 preliminary studies only. They are intended to inform early-stage decision-making and do not constitute:

  • Architectural design services (RIBA Stages 2-7)

  • Detailed planning applications or submissions

  • Building Regulations applications or compliance certification

  • Structural engineering designs or calculations

  • Legal advice regarding covenants, title issues, or contracts

2.4 Remote Assessment Methodology

CRITICAL LIMITATION: All assessments are conducted remotely using:

  • Information provided by the Client via online forms

  • Photographs and documents uploaded by the Client

  • Publicly available data (Google Maps/Street View, planning portals, designation databases)

  • Planning policy documents and guidance

We do not conduct physical site visits as part of standard service packages. Site-specific issues not visible in photographs or satellite imagery may not be identified.

2.5 Geographic Limitation

Services are provided for properties located in England only. We do not provide assessments for properties in Scotland, Wales, Northern Ireland, or outside the United Kingdom.

2.6 Service Exclusions

Perfect Scale does NOT provide:

  • Formal planning applications or submission services

  • Architectural or engineering design services

  • Building Regulations applications

  • Party Wall surveys or Party Wall Act notices

  • Legal advice on property law, covenants, or contracts

  • Quantity surveying or cost management

  • Project management or construction supervision

  • Valuations or mortgage advice

  • Guaranteed planning outcomes or approvals

3. PROFESSIONAL STATUS AND LIMITATIONS

3.1 Professional Qualifications

IMPORTANT NOTICE: Perfect Scale is operated by Abre Etteh, a qualified architect registered with the Architects Registration Board (ARB). However, the feasibility assessment service provided by Perfect Scale is a preliminary information and analysis service only, operating at RIBA Stage 0/1.

Perfect Scale services do NOT include:

  • Full architectural design services (RIBA Stages 2-7)

  • Formal planning applications or submissions on your behalf

  • Detailed design drawings for construction

  • Site supervision or contract administration

3.2 Information Service

Our service is designed to support early-stage feasibility assessment and decision-making. While architectural expertise informs our analysis, the reports are preliminary assessments that do not replace the need for:

  • Detailed architectural design work for planning applications

  • Structural engineering input

  • Building Control liaison

  • Other professional services required for construction

3.3 Requirement for Further Professional Input

ALL FINDINGS AND RECOMMENDATIONS in our reports are preliminary assessments. Before proceeding to formal applications or construction, you must engage appropriately qualified professionals as follows:

3.4 No Authority to Act

We have no authority to:

  • Submit planning applications on your behalf

  • Correspond with Local Planning Authorities as your agent

  • Instruct contractors, architects, or other professionals on your behalf

  • Make binding commitments regarding your property

  • Provide statutory certifications or approvals

4. NO GUARANTEES OR WARRANTIES

4.1 Planning Outcomes

WE MAKE NO GUARANTEE, WARRANTY, OR REPRESENTATION that:

  • Planning permission will be granted

  • Permitted Development rights apply to your proposal

  • Building Regulations approval will be obtained

  • Party Wall agreements will be reached

  • Costs will not exceed estimates

  • Timelines will be achieved

  • Neighbours will not object

  • Any development will proceed successfully

4.2 Approval Likelihood Assessments

Where we provide percentage likelihood estimates (e.g., "75% likely to approve"), these are professional opinions based on available information, not predictions or guarantees. Actual outcomes depend on:

  • Local Planning Authority interpretation

  • Planning officer assessment

  • Committee decisions (if applicable)

  • Neighbour representations

  • Site-specific factors discoverable only through site visits

  • Changes in planning policy

  • Political considerations

4.3 Permitted Development Assessments

Permitted Development assessments are based on our interpretation of the Town and Country Planning (General Permitted Development) (England) Order 2015 and available information. Only a Local Planning Authority can definitively confirm whether Permitted Development rights apply. We recommend obtaining a Lawful Development Certificate for certainty before proceeding with construction.

4.4 Cost and Timeline Estimates

All cost and timeline estimates are indicative only and based on:

  • Industry averages and typical rates

  • Assumptions about site conditions

  • Standard construction methods

  • Normal contractor availability

Actual costs and timelines may vary significantly due to:

  • Site-specific ground conditions

  • Material price fluctuations

  • Contractor availability and pricing

  • Design complexity

  • Unforeseen issues during construction

  • Regulatory delays

  • Supply chain issues

  • Economic conditions

We are not liable for cost overruns or timeline delays.

4.5 Information Accuracy

While we use reasonable endeavours to ensure accuracy, we:

  • Rely on information provided by Clients (which we do not independently verify)

  • Use publicly available data (which may be out of date or incorrect)

  • Cannot access all Local Planning Authority records

  • Cannot predict future policy changes

  • Cannot anticipate all site-specific constraints

We do not warrant that all information in our reports is complete, current, or error-free.

5. CLIENT OBLIGATIONS

5.1 Accurate Information

You agree to provide:

  • Complete and accurate information about your property and proposal (where exact measurements are available)

  • Best estimates for dimensions, floor areas, and other measurements where exact figures are not available - we understand that precise measurements may not be possible before engaging a surveyor, and good-faith estimates are acceptable

  • Clear, recent photographs of all relevant elevations

  • Copies of any relevant documents (title deeds, previous planning applications, etc.)

  • Honest disclosure of any known constraints, covenants, or issues

You are responsible for the accuracy of information you provide. We are entitled to rely on your information without independent verification. Where you provide estimates rather than exact measurements, we will base our analysis on those estimates and clearly note in our report where assumptions have been made.

5.2 Property Ownership or Authority

You confirm that you:

  • Own the property subject to the assessment, OR

  • Have explicit authority from the property owner to commission this assessment, OR

  • Are acting as a professional advisor to the property owner with their consent

5.3 Timely Communication

You agree to:

  • Respond to any clarification requests within 5 working days

  • Notify us immediately of any material changes to your proposal or circumstances

  • Inform us of any errors or omissions you identify in our report

5.4 Use of Reports

You agree to:

  • Use reports solely for the property and proposal described

  • Not rely on reports for alternative proposals without written consent

  • Obtain updated reports if proceeding more than 90 days after report date

  • Share reports with appointed professionals (architects, engineers, etc.) as needed

  • NOT rely on reports as a substitute for professional design, engineering, or legal advice

5.5 Prohibited Uses

You agree NOT to:

  • Use reports to make planning applications without architect validation

  • Use reports for properties in Scotland, Wales, Northern Ireland, or outside the UK

  • Reproduce, distribute, or commercialise reports without written permission

  • Claim that reports constitute formal planning advice or architectural services

  • Use reports to mislead third parties about planning prospects

  • Rely on reports beyond their 90-day validity period

6. PAYMENT TERMS

6.1 Service Fees

Current fees are:

  • Residential Extension Assessment: £75-£150

  • Additional Services: As quoted

All fees are stated as final prices. As a sole trader not registered for VAT, no VAT is charged or added to these fees.

6.2 Payment in Advance

Payment is required in full in advance before we commence analysis. We accept:

  • Credit/Debit card via secure payment gateway

  • Bitcoin (BTC) - contact reports@perfect-scale.co.uk for wallet address and current rate

6.3 No Work Without Payment

We will not commence any work until payment is received and confirmed. Submission of an enquiry form does not constitute an order until payment is made.

6.4 Non-Refundable

All fees are non-refundable once work has commenced, except as provided in Section 8 (Cancellation and Refunds). "Work commenced" means we have begun analysis of your case, typically within 1 working day of payment confirmation.

6.5 Price Changes

We reserve the right to change our fees at any time. Price changes will not affect orders already paid for.

6.6 Additional Fees

Additional fees may apply for:

  • Revised reports (if you change your proposal): £50-£100

  • Refreshed reports (after 90-day validity period): 50% of original fee

  • Additional research or analysis not included in standard service: £75/hour

You will be quoted any additional fees before work commences, and your acceptance will be required.

7. DELIVERY AND TIMELINES

7.1 Standard Turnaround

Standard turnaround time for all services is 5 working days from receipt of full payment and complete information. Working days exclude weekends and UK public holidays.

Average turnaround time is typically 24-48 hours, but this is not guaranteed. The 5 working day standard turnaround is the maximum expected timeframe under normal circumstances.

7.2 Timing Starts from Payment and Complete Information

Turnaround time begins when:

  • Full payment is received and confirmed, AND

  • All required information and photographs have been provided

If we request additional information or clarifications, the timeline will be paused until we receive your response.

7.3 Delivery Method

Reports will be delivered as password-protected PDF documents via email to the address provided during purchase.

7.4 No Liability for Delays

While we use reasonable endeavours to meet stated turnaround times, we are not liable for delays caused by:

  • High demand or workload

  • Technical issues (email delivery, website downtime, etc.)

  • Incomplete information requiring clarification

  • Complex cases requiring additional research

  • Events beyond our reasonable control (force majeure)

8. CANCELLATION AND REFUNDS

8.1 Client Right to Cancel

You may cancel your order and receive a full refund if:

  • You cancel before we commence analysis (typically within 24 hours of payment)

  • You notify us by email at reports@perfect-scale.co.uk with your order reference

8.2 No Refund After Work Commences

Once analysis has commenced, no refund will be provided, except where:

  • We fail to deliver a report within 14 working days of complete information being provided (excluding force majeure)

  • We provide a materially deficient report that does not meet the service description (at our sole discretion)

8.3 Request for Refund

Refund requests must be made in writing to reports@perfect-scale.co.uk within 14 days of report delivery, stating the reasons and specific deficiencies. We will assess the request and respond within 7 working days.

8.4 Refund Discretion

All refund decisions are at our sole discretion. Grounds that will NOT qualify for a refund include:

  • Disagreement with our professional opinion or assessment

  • Planning permission being refused after we predicted approval

  • Costs exceeding our estimates

  • Timelines not being met

  • Discovering issues that were not visible in photographs or submitted information

  • Changing your mind about proceeding with the development

  • Finding a cheaper alternative service after purchasing

8.5 Refund Processing

Approved refunds will be processed within 14 working days using the original payment method.

9. INTELLECTUAL PROPERTY

9.1 Report Ownership

All reports, analysis, methodologies, templates, and content created by Perfect Scale remain our intellectual property. Upon payment, we grant you a non-exclusive, non-transferable licence to use the report solely for:

  • Your personal assessment of the specific property and proposal described

  • Sharing with professional advisors you appoint (architects, engineers, solicitors, etc.)

  • Sharing with mortgage providers or financial institutions if required

9.2 Restrictions on Use

You may NOT:

  • Reproduce or distribute reports commercially

  • Use reports for alternative properties or proposals without written permission

  • Remove Perfect Scale branding or attribution

  • Claim authorship of the analysis or content

  • Use reports to compete with Perfect Scale or offer similar services

  • Extract our methodologies or templates for commercial use

9.3 Third-Party Reliance

Reports are prepared solely for the named Client for the property and proposal described. Third parties (including buyers, sellers, lenders, or neighbours) may not rely on the report without our written consent, which may be subject to additional fees.

9.4 Website Content

All content on the Perfect Scale website, including text, graphics, logos, images, and software, is our property or licensed to us. You may not copy, reproduce, or distribute website content without written permission.

10. LIABILITY AND INDEMNIFICATION

10.1 Exclusion of Consequential Losses

To the fullest extent permitted by law, Perfect Scale shall NOT be liable for any:

  • Indirect or consequential losses, including but not limited to:

    • Loss of profits or revenue

    • Loss of opportunity

    • Loss of goodwill

    • Loss of anticipated savings

    • Costs of alternative services

    • Business interruption

  • Losses arising from:

    • Planning permission refusal or conditions

    • Delays in obtaining approvals

    • Cost overruns or budget exceedance

    • Construction defects or failures

    • Disputes with contractors, neighbours, or authorities

    • Changes in planning policy or interpretation

    • Inaccuracies in third-party information sources

    • Site-specific constraints not visible during remote assessment

10.2 Maximum Liability Cap

Our total aggregate liability to you for any claim arising from or in connection with our services shall not exceed the fees paid by you for the specific report in question.

This liability cap applies regardless of the legal basis for the claim (whether contract, tort, negligence, breach of statutory duty, or otherwise).

10.3 Exceptions to Liability Limits

Nothing in these Terms shall exclude or limit our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any other liability that cannot be excluded or limited by English law

10.4 Professional Indemnity Insurance

We maintain appropriate insurance coverage as follows:

Professional Indemnity Insurance:

  • Insurer: AXA Insurance UK plc

  • Policy Number: 550.238.119

  • Limit of Indemnity: £250,000 per claim

  • Policy Period: 27 September 2025 to 26 September 2026

  • Retroactive Cover: From 1 September 2014

Public Liability Insurance:

  • Insurer: AXA Insurance UK plc

  • Policy Number: 550.238.119

  • Limit of Indemnity: £1,000,000 per event

  • Policy Period: 27 September 2025 to 26 September 2026

Copies of our insurance certificates are available upon request.

10.5 Claims Procedure

Any claim must be:

  • Notified to us in writing within 6 months of report delivery (or when you became aware of the issue, if later)

  • Supported by evidence of loss or damage

  • Accompanied by copies of all relevant correspondence and documentation

Failure to notify claims promptly may affect your ability to recover.

10.6 Client Indemnification

You agree to indemnify and hold harmless Perfect Scale, its directors, employees, and contractors from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your misuse of our reports or recommendations

  • Inaccurate or incomplete information you provided

  • Your failure to obtain required professional validation before proceeding

  • Your breach of these Terms

  • Your use of reports for purposes other than intended

  • Claims by third parties who rely on reports without our consent

11. DATA PROTECTION AND PRIVACY

11.1 Data Controller

Perfect Scale (trading name of Abre Etteh) is the data controller for personal information you provide. We process data in accordance with UK GDPR and Data Protection Act 2018.

11.2 Information We Collect

We collect and process:

  • Contact information: Name, email, phone number, address

  • Property information: Address, postcode, photographs, documents

  • Payment information: Payment card details (processed securely by third-party payment providers; for Bitcoin payments, wallet addresses only)

11.3 Legal Basis for Processing

We process your data under the following legal bases:

  • Contract performance: To deliver the services you have purchased

  • Legitimate interests: To improve our services, prevent fraud, and maintain records

  • Legal obligations: To comply with tax, accounting, and regulatory requirements

  • Consent: For marketing communications (where you have opted in)

11.4 How We Use Your Information

We use your information to:

  • Provide feasibility assessment services

  • Communicate with you about your order

  • Process payments and prevent fraud

  • Improve our services and website functionality

  • Send service updates and important notices

  • Send marketing communications (if you have consented)

  • Comply with legal obligations

11.5 Information Sharing

We do not sell your personal information. We may share information with:

  • Payment processors: To process transactions securely

  • Professional advisors: Lawyers, accountants, insurers (as necessary)

  • Regulatory authorities: If required by law

  • Service providers: Email hosting, website hosting, analytics (under strict confidentiality)

We do NOT share property addresses, photographs, or proposal details with third parties except as required by law.

11.6 Data Retention

We retain your data for:

  • Contact and order information: 7 years (for tax and legal compliance)

  • Reports and analysis: 7 years (for professional indemnity insurance purposes)

  • Marketing communications: Until you unsubscribe

  • Website analytics: 26 months (anonymised)

11.7 Your Rights

Under UK GDPR, you have the right to:

  • Access your personal data (subject access request)

  • Rectification of inaccurate data

  • Erasure ("right to be forgotten") in certain circumstances

  • Restriction of processing in certain circumstances

12. REPORT VALIDITY AND LIMITATIONS

12.1 Report Validity Period

All reports are valid for 90 days from the date of issue. After this period:

  • Planning policy may have changed

  • Site conditions may have altered

  • Market conditions affecting costs may have shifted

  • Information sources may be out of date

12.2 Refreshed Reports

If you wish to proceed after 90 days, you must obtain a refreshed report (typically 50% of original fee) to ensure information is current.

12.3 Material Changes

If any of the following occur after report delivery, the report may no longer be valid:

  • Changes to your proposal (dimensions, materials, design)

  • Changes to the property (new extensions, alterations)

  • Changes to planning policy (new Local Plan, SPDs, Article 4 Directions)

  • Changes to designation status (new Conservation Area, TPO, etc.)

  • Changes to ownership or title issues

You must notify us immediately of material changes and may require a revised report (additional fees apply).

12.4 Report Limitations Summary

Reports are based on:

  • Remote analysis (photographs, satellite imagery)

  • Publicly available data (planning records, designation databases)

  • Information provided by the Client

  • Planning policy current at report date

Reports do NOT include:

  • Physical site visits or measured surveys

  • Title deed reviews or legal searches

  • Structural surveys or ground investigations

  • Utility company searches

  • Detailed neighbour impact assessments (e.g., sunlight/daylight studies)

  • Drainage surveys or flood risk assessments

  • Ecological surveys or tree surveys

  • Access to non-public Local Planning Authority records

  • Predictions of future policy changes

13. DISPUTE RESOLUTION

13.1 Initial Contact

If you are dissatisfied with our service, please contact us immediately at reports@perfect-scale.co.uk with:

  • Your order reference

  • Nature of the issue

  • Supporting evidence or documentation

We will acknowledge your complaint within 2 working days and aim to resolve it within 14 working days.

13.2 Informal Resolution

We are committed to resolving disputes amicably and will:

  • Investigate your concerns thoroughly

  • Provide a detailed written response

  • Offer remedies where appropriate (which may include partial refunds, revised reports, or additional analysis)

13.3 Formal Complaints Procedure

If informal resolution is unsuccessful:

  1. Written Formal Complaint: Submit a formal written complaint to reports@perfect-scale.co.uk clearly marked "FORMAL COMPLAINT"

  2. Response: We will provide a final written response within 21 days

  3. Alternative Dispute Resolution (ADR): If still unresolved, we may propose ADR through an independent mediator (costs to be shared equally)

13.4 Limitation Period

Any legal claim must be brought within 12 months of the issue arising or report delivery (whichever is earlier). Claims brought after this period will be time-barred.

13.5 Governing Law and Jurisdiction

These Terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreement, constitute the entire agreement between you and Perfect Scale. They supersede all prior discussions, negotiations, or agreements.

14.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative.

14.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a third party (e.g., in the event of a business sale) upon notice to you.

14.5 Third-Party Rights

These Terms are between you and Perfect Scale only. No third party has any right to enforce any provision under the Contracts (Rights of Third Parties) Act 1999.

14.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (floods, storms, earthquakes)

  • Pandemics or public health emergencies

  • War, terrorism, or civil unrest

  • Government restrictions or legislation

  • Strikes or industrial action

  • Failure of third-party services (internet, payment providers, databases)

  • Cyber-attacks or technical failures

During force majeure events, our obligations will be suspended for the duration of the event.

14.7 Notices

All notices must be in writing and sent to:

  • Client: The email address provided during purchase

Notices are deemed received:

  • If by email: On the day sent (if sent before 4pm on a working day; otherwise, the next working day)

  • If by post: 2 working days after posting (UK addresses)

14.8 Relationship

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Perfect Scale. You are an independent client purchasing a service.

14.9 Headings

Headings in these Terms are for convenience only and do not affect interpretation.

14.10 Language

These Terms are drafted in English. If translated, the English version shall prevail in case of inconsistency.

15. SPECIFIC SERVICE TERMS

15.1 Residential Extension Assessments

Service includes:

  • Permitted Development rights assessment

  • Planning permission likelihood analysis

  • Neighbour impact evaluation

  • Cost and timeline estimates

  • Risk assessment

Service does NOT include:

  • Architectural drawings or designs for planning submission

  • Planning application submission

  • Detailed measured surveys

  • Structural engineering calculations

Client acknowledgment: You confirm you understand that:

  • Reports do not guarantee planning approval

  • Detailed design work must be completed before submitting planning applications

  • Structural engineers must assess structural feasibility

  • Building Regulations approval is separate from planning permission

IMPORTANT NOTICE: Perfect Scale uses artificial intelligence tools to assist with analysis and backtesting of historical planning decisions to improve our methodology. By using our services, you:

  • Acknowledge that AI tools are used to support (but not replace) human expert analysis

  • Understand that AI has limitations and may not identify all issues

  • Agree that all final assessments are reviewed and approved by qualified analysts

  • Accept that historical backtesting accuracy does not guarantee future prediction accuracy

  • Recognise that planning decisions are inherently subjective and dependent on specific circumstances

We are transparent about our use of AI and continually refine our methodology based on real-world outcomes.

16. TESTIMONIALS AND CASE STUDIES

16.1 Use of Feedback
